Australia’s international education sector worth more than previously estimated

The Turnbull Government has released today a new landmark report by Deloitte Access Economics, The Value of International Education to Australia, which reveals the sector contributes $1 billion more to the economy than previously estimated.

International education is already one of our top two services exports, along with tourism, and is one of five key super-growth sectors that will support our transitioning economy into the next decade.

The growing importance of international education to Australia is evident from the more than 130,000 jobs it creates and the businesses that benefit from it – directly and indirectly across the retail, hospitality, property sectors and more.

This important new report identifies a number of additional revenue streams not routinely captured by the Australian Bureau of Statistics (ABS), which reported the value of international education to be over $19.5 billion in 2015, making it one of our largest export earners.

The additional streams identified in this report total nearly $1 billion more what the ABS currently reports, putting the real value of the industry closer to $21 billion.

These newly-identified revenue streams include nearly $300 million that students’ visiting family and friends contribute to Australia’s tourism industry each year.

Also, for the first time, this report provides an estimate of the national economic contribution made by Australian education providers delivering Australian courses offshore, which was over $400 million in 2014-15.

Education related expenditure by those on non-student visas studying English is estimated to contribute an additional $205 million in export revenue.

The Turnbull Government recognises that Australia’s knowledge and innovation boom has just begun and on Saturday in Launceston, Tasmania we will be releasing our National Strategy on International Education, laying out a framework for the future of the industry.

Immigration Lawyer Brisbane - Subclass 485 Visa Guide!

As Immigration Lawyers, we speak to many international students in Australia looking for visa options after the completion of their studies. In fact, that is why we wrote one of our previous blogs which has gone on to receive some great feedback. Accordingly, the aim of this blog is to clarify the Subclass 485 visa, otherwise referred to as the Graduate or Post-Study visa available to international students who have completed at least 2 years of academic study in the country.

Importantly, as the above diagram demonstrates, although there are common criteria applicable to all applicants, there are two streams to this visa, the Graduate Work Stream and the Post-Study Stream, each with specific requirements. So lets have a closer look.

Common Criteria

The common criteria for all 485 visa applicants requires that they have not held a Subclass 485 visa previously (its a one time deal!), have achieved the required score in their English testing, have arranged for both their Australian Federal Police clearance and health insurance prior to the application of the visa and meet health and character requirements. Both streams also require that applicants have completed at least 92 weeks of study in Australia within the 6 months prior to applying for the visa.

Graduate Work Stream

The Graduate Work Stream is available for those who have completed their studies in Australia relevant to an occupation on the Skilled Occupation List (SOL). Importantly, each qualification used to satisfy the Australian Study Requirement must be both closely related to the nominated occupation on the SOL and be at least at a Degree, Diploma or Trade Certificate level.

For example, a Certificate IV in Business cannot be used to meet the 92 week study requirement as it is neither a Diploma nor a trade certificate. Additionally, someone nominating the occupation of Carpenter cannot use a Certificate IV in Commercial Cookery, as although this is a trade qualification, it is not closely related to the nominated occupation. 

Lastly, applicants under this stream must ensure that prior to submitting their visa application to the DIBP that they have applied for their migration skills assessment from the respective Skills Assessing Authority associated to their nominated occupation. If you are unsure of your skills assessing authority, refer to the second column of theSOL. 

If successful, applicants under the Graduate Work Stream will be granted a visa valid for 18 months.

Post-Study Work Stream

The Post-Study Work Stream is available to applicants who have completed 92 weeks of study at a Bachelor level or higher. The benefit of this stream is that it does not require applicants to have studied a field related to an occupation on the SOL nor does it require applicants to apply for a migration skills assessment for grant of the visa. However, as Migration Agents in Brisbane, we advise people that this stream is only available to applicants who applied for their first student visa to Australia after the 5 November 2011. Unfortunately there is no leniency with this provision and those who applied for their first student visa anytime before the 5 November 2011 will be unable to apply under this stream. However, they may still qualify under the Graduate Work Stream mentioned above.

If successful, applicants under the Post-Study Work stream will be granted a visa valid for 2-4 years, depending on the level of qualification obtained.

High-achieving individuals from Australia and around the world who wish to undertake an international study, research and professional development experience can now apply for an Endeavour Scholarship or Fellowship for 2017.

The Turnbull Government recognises that education is vital for building a more innovative and globally competitive workforce.

The Endeavour programme strengthens Australia’s reputation for excellence in education and research while opening up both sectors to the world.

The scholarships and fellowships offer high-achieving individuals from overseas and Australia opportunities to increase their productivity and expertise in their chosen field.

They enable Australian postgraduate students to do short-term research in any field while overseas towards an Australian Masters or PhD, while a fellowship supports Australian postdoctoral fellows undertaking short-term research and/or professional development overseas.

Applications are also open for institutions applying for the 2017 round of Endeavour Mobility Grants. These grants support Australian undergraduate, postgraduate and vocational education and training students to experience international study that contributes to their Australian qualification.

The Endeavour Mobility Grants programme supports students undertaking overseas study as part of their qualification, creates opportunities for students to engage globally and strengthens the capacity of higher education institutions to collaborate and partner with overseas education providers, business and other stakeholders.

An important feature of the Endeavour programme is the Government’s long-standing partnership with Cheung Kong, which will again see a continuation of student exchanges between Australia and Asia.

The Endeavour Scholarships and Fellowships, the Endeavour Mobility Grants and the New Colombo Plan are highly regarded initiatives.

The Turnbull Government is committed to opening up study and research opportunities for both Australian and international students here and overseas, and this will be reflected in our soon to be released National Strategy for International Education.

The 2017 round of the Endeavour Scholarships and Fellowships close on 30 June while the 2017 round of Endeavour Mobility Grants are open until 10 June.

Subclass 457 & Student Visas - Immediate Changes

Following on from our previous blog which advised of possible changes to the Subclass 457 visa scheme, the following minor amendments have recently been announced and will commence from the 19 April 2016:

  • The introduction of a new Subclass 457 obligation on standard business sponsors that they not engage discriminatory recruitment practises, on the grounds of immigration status or citizenship is introduced.
  • Amendment of the Internet application process so that requiring visa applicants to enter the nomination details in their application to streamline the application.
  • The removal of the requirement for applicants to provide English testing where this is already required for occupational licencing or registration.

Perhaps more importantly however are the sweeping changes to the current Student visa framework with the simplification of visa Subclasses and the implementation of the following amendments:

  • The reduction of visa subclassess available to two student visa subclasses only: Subclass 500 (Student) and Subclass 590 (Student Guardian)
  • Streamline application and processing requirements for student visa applicants, with common criteria and genuineness of application for entry and stay as a student
  • Simplify range of requirements including enrolment, financial and other requirements relating to visas previously held if the application is made in Australia
  • The current regulatory assessment level framework and streamlined processing provisions will be repealed and new requirements introduced to strengthen the integrity of the programme, by providing a larger range of factors for decision makers to assess genuineness and the need for individuals to provide evidence of financial and English proficiency
  • Clarify for student visa holders the conditions on the courses they are permitted to undertake and when a change of course would require them to apply for a new student visa
  • Make other amendments to repeal duplicate and redundant provisions and clarify the operation of the relevant provisions

The background behind the major online accommodation websites

When searching on the internet for accommodation, it can be quite a daunting task with many options available, particularly in large towns and cities. So a quick way to get an overview of these many options is to use an online travel website. They can display availability and pricing for many hotels at once, so at a glance you may be able to find something suitable without individually going to each hotel’s website.

There are many online travel websites which feature listings for accommodation in Australia and throughout the world, but most belong to either one of two large groups.

It is important to realise that searching for accommodation within a specific accommodation group will yield the same results. So, for example, search for somewhere to stay on wotif.com, and you will get exactly the same results as if you had searched on expedia.com. What may be different is the layout of the website, the search mechanism, loyalty reward schemes, and the ways guests can get customer support.

Between the two major groups listed above, there may be price differences between individual accommodation properties. However, in general, they are limited to special offers or campaign sales. For example, we did a search for a one night stay at a specific hotel in the popular Melbourne inner northern suburb of Brunswick on several websites within these two major groups. For most room types, the tariffs were identical. But within the Expedia group, they were promoting a sale at the hotel of our choice on deluxe queen rooms, which resulted in the nightly pricing dropping from the standard $145 down to $108 on all the websites within that group.

Based on that, one could conclude that best way to get the lowest pricing when using online travel websites is to pick one from each of the two major groups and search those.

Another option is to use what is known as a meta search engine website. These gather pricing for accommodation through a large number of booking websites and present the combined results.

Meta hotel searchSome major meta search engines for hotel bookings are:

A few years ago, using these meta search engines was really the way to go. This was because many of today’s popular online travel booking sites were actually independantly owned and managed, with their own arrangements between suppliers of accommodation. This meant there were many instances of wide variability in pricing and the presence of some hotels across all those sites. But in the last few years, many popular online travel booking sites have been bought out by big groups, including Australia’s Wotif which was acquired by Expedia in late 2014. What exists now is basically a duopoly between the websites that are part of Priceline Group and those that Expedia Inc runs.

Is this the end for hotel meta search engines? Yes and no.

While Priceline and Expedia control many of the world’s most popular accommodation booking sites, there are a few smaller ones out there which are still independant and do offer unique deals, so using a hotel meta search engines can easily sniff these out for you.

Australian-based HotelsCombined is an interesting meta search engine. Like Trivago and Kayak, it searches websites belonging to the major online travel groups and combines the results. However, it also has arrangements in place with some hotel chains, like Best Western for example, such that it can get pricing directly from the hotel, rather than through the major online travel websites that the hotel has listed itself on. While this sounds good in practice, it may not actually mean you get a room cheaper when booking direct, as there is usually a rate parity arrangement in place which prohibits the hotel from advertising a cheaper rate on its own website than through the major online travel groups.

Had a Visa Cancelled or Departed Unlawfully? Understand Your Options

​In a recent blog article we discussed the issues people can face if they have had a visa cancelled previously in Australia. Importantly, these problems arise by virtue of a set of strict visa criteria known as Public Interest Criteria (PIC). Accordingly, the aim of this blog will be to better explain what exactly PIC is, when it applies and what options there are to ‘get around them’.

The purpose of PIC is to identify visa applicants who may pose a risk to Australia because of previous breaches of immigration law and preclude certain persons from entering Australia, or in other words, make it harder for people who have done not so good things from staying or coming back. Arguably, the two most common types of PIC people often run afoul of are PIC4013 and PIC4014 respectively. Importantly, both PIC4013 and PIC4014 contain 'exclusion periods’, meaning that if an applicant does not satisfy the criteria set out in each respective PIC, then unless exceptions apply, they cannot be granted a visa within a specific time frame - more commonly referred to as a 'ban’ or 'red flag’ from having a visa granted.

What Is PIC4013

PIC4013 applies to people who have had a visa cancelled under certain provisions within the Migration Act. Accordingly, if an applicant 'fails’ PIC4013 - as in they have had a visa cancelled and are applying for a new visa within three years of the visa cancellation - then unless there are  compelling circumstances that affect the interests of Australia or compassionate or compelling circumstances that affect the interests of an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen, then the newly applied visa cannot be granted. However, this does not necessarily apply to all new visas applied for (better explained below).

What is PIC4014

PIC4014 on the other hand relates to visa applicants who are applying for a visa to Australia after having departed Australia after being unlawful, or the holder of a BVC, BVD or BVE for more than 28 days. Accordingly, for applicants who fall within this description and are applying within 3 years of their departure from Australia, unless there are compelling circumstances that affect compassionate or compelling circumstances that affect the interests of an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen, then as above, the new visa cannot be granted. 

Options If You Fail PIC4013 and PIC4014

Importantly however, despite the operation of both PIC4013 and PIC4014, if an applicant fails either (or both) of those PIC, if the new visa being applied for does not have PIC4013 or PIC4014 as a criteria for the grant of that specific visa, then applicants can still have another visa granted. For example, PIC4013 and PIC4014 do not apply to ENS (186), RSMS (187) or Partner visas, just to name a few. Possible Overhaul of Subclass 457 Visa Scheme

A recent senate committee report titled ‘A National Disgrace: The Exploitation of Temporary Work Visa Holders' could lead to widespread reform to the current Subclass 457 scheme after its 33 recommendations were published last month. 

Accordingly, some of these recommendations include:
  1. The removal of labour market testing exemptions which currently exist for certain occupations.
  2. Employers sponsoring in professional occupations to be required to employ an Australian graduate on a one-on-one basis.
  3. Employers sponsoring in trade occupations demonstrate that 25% of their workforce be made up of apprentices.
  4. Current training benchmarks be replaced with with a 'training levy’ per 457 visa worker to the value of $4000 per 457 worker.

Importantly however, the report also commented on temporary visas more generally. For example, the report also made the following recommendations:
  1. An examination into the costs and benefits of continuing the operation of a second year for Working Holiday visa holders.
  2. A greater emphasis being placed on time spent living in Australia when considering eligibility for permanent residency.

Australian Visa Options

The No.1 most common type of Migration Advice people seek revolves around the age old question 'what are my visa options to stay in Australia?'

I will break down the different visa pathways into eight (8) separate categories. Skilled Visas, Student Visas, Sponsored Visas, Temporary Work Visas, Family Visas, Business Visas, Visitor Visas, New Zealand Citizens Visas and Other Visas. Within each of these eight categories there can be several visa classes, all of which have their own unique and distinct eligibility criteria.

Importantly, some visas, such as Student or Visitor visas, although are generally only intended for short stays in Australia, are often used by applicants as a 'stepping stone' to a more substantial and longer term visa. For example, following the completion of their studies, Student visa holders may find suitable employment and be eligible for a Sponsor visa if their Australian employer is willing to sponsor them and meets specific criteria. Alternatively, students who have studied in a highly skilled area may be eligible to apply for a Skilled visa, based on factors such as their points score and their ability to obtain a Migration Skills Assessment in their occupation.

Similarly, Visitor visas are commonly used by applicants who have Australian partners as a way of entering the country and then applying for a Partner visa from inside Australia, enjoying the benefit of a 'Bridging Visa' which allows them to stay inside the country with their Australian partners while the new visa is processing. This is often seen as preferable to applying from outside Australia where they may otherwise be forced to spend long periods of time separated from their Australian partners waiting for their new visa.
